Terms of Service

Welcome to ReconHI ("we," "us," or "our"). ReconHI is a curated marketplace that connects travelers with locally owned activity providers across the Hawaiian Islands. By accessing or using our platform — including our website, mobile experience, and any related services — you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use ReconHI. These Terms constitute a legally binding agreement between you and ReconHI. We encourage you to read them carefully and revisit this page periodically, as we may update these Terms from time to time.

ReconHI operates as an intermediary marketplace. We connect guests seeking authentic Hawaiian experiences with independent, locally vetted vendors who provide those experiences. ReconHI does not own, operate, or directly provide any of the activities, tours, rentals, or services listed on the platform. Each vendor is an independent business responsible for the quality, safety, and delivery of their offerings. ReconHI facilitates discovery, booking, payment processing, and communication — but the contractual relationship for each experience is between the guest and the vendor.

To use ReconHI, you must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. By creating an account or completing a booking, you represent and warrant that you meet this requirement. Minors may participate in activities only when accompanied by a parent or legal guardian who has accepted these Terms and any applicable waivers. Certain experiences may have additional age, health, or fitness requirements as specified by the vendor.

All bookings on ReconHI are processed through Stripe, our secure payment partner. When you book an experience, your payment method is authorized and charged at the time of booking confirmation. Prices displayed on the platform are in US Dollars (USD) unless otherwise stated. ReconHI collects a platform service fee on each transaction. This fee supports platform operations, vendor vetting, customer support, and ongoing development. The total price shown at checkout includes all applicable fees. Vendors receive payouts through their connected Stripe Express accounts after the experience has been completed. ReconHI does not store your full credit card details — all sensitive payment information is handled directly by Stripe in compliance with PCI-DSS standards. By completing a booking, you authorize ReconHI to charge your selected payment method for the total amount displayed at checkout.

Cancellation policies vary by listing and are displayed on each experience's detail page before you complete your booking. Please review the applicable policy carefully before confirming your reservation. General guidelines: Guest-initiated cancellations made within the eligible cancellation window (typically 48 hours or more before the experience start time) are eligible for a full refund, including the platform fee. Late cancellations or no-shows may not be eligible for a refund, depending on the vendor's stated policy. In such cases, the platform fee is retained. Vendor-initiated cancellations or cancellations due to weather or safety concerns entitle the guest to a full refund, including the platform fee. Partial refunds may be issued at the discretion of the vendor or ReconHI support team, with the platform fee refunded proportionally. Refund requests should be submitted through the Reach Out page or by contacting our support team. Refunds are processed to the original payment method and may take 5–10 business days to appear on your statement.

Vendors listed on ReconHI are independent operators. Each vendor is solely responsible for the accuracy of their listing descriptions, pricing, availability, safety protocols, required permits or licenses, and the overall quality of the experience they deliver. Vendors agree to comply with all applicable local, state, and federal laws, including those related to tourism, safety, insurance, and environmental protection. ReconHI reserves the right to remove any vendor or listing that fails to meet our quality standards or violates these Terms. ReconHI conducts an initial review of vendor applications but does not independently verify every claim made by vendors. Guests are encouraged to review ratings, read reviews, and ask questions before booking.

Many experiences offered through ReconHI involve outdoor activities, water sports, hiking, aerial tours, and other pursuits that carry inherent risks. By booking and participating in any experience, you acknowledge and voluntarily assume all risks associated with that activity, including but not limited to physical injury, property damage, illness, or death. You agree to follow all safety instructions provided by the vendor and to disclose any relevant medical conditions, physical limitations, or allergies prior to participation. Some experiences may require you to sign a separate waiver or liability release provided by the vendor. ReconHI strongly recommends that all guests obtain appropriate travel and activity insurance before participating in any experience.

To the fullest extent permitted by applicable law, ReconHI, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform or participation in any experience. ReconHI's total aggregate liability to you for any claims arising from your use of the platform shall not exceed the amount you paid to ReconHI in platform fees during the twelve (12) months preceding the event giving rise to the claim. This limitation applies regardless of the theory of liability, whether based on contract, tort, negligence, strict liability, or any other legal theory, and whether or not ReconHI has been advised of the possibility of such damages.

When you create an account on ReconHI, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use. You agree not to use ReconHI for any unlawful purpose, to impersonate any person or entity, to interfere with the platform's operation, to submit false or misleading information, or to engage in any conduct that could harm other users, vendors, or the platform itself. ReconHI reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or otherwise poses a risk to the community.

All content on the ReconHI platform — including but not limited to the logo, brand name, website design, text, graphics, photographs, icons, and software — is the property of ReconHI or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from ReconHI without our prior written consent. Vendor-submitted content (listing descriptions, photos, etc.) remains the property of the respective vendor, with a license granted to ReconHI for platform display and marketing purposes.

ReconHI reserves the right to modify, update, or replace these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, provide notice through the platform or via email. Your continued use of ReconHI after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use of the platform.

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaiʻi, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of ReconHI shall be resolved exclusively in the state or federal courts located in Honolulu County, Hawaiʻi. You consent to the personal jurisdiction of such courts and waive any objection to venue.
